For the administrative courts, two decisions of principle are worth noting, in connection with "référé-liberté" (a kind of summary proceeding) and the application of the precautionary principle to species protection. Beyond this, more cross-cutting questions recur, such as the scope of application of the Charter in relation to notions of the environment and effects on the latter. The Charter’s position in relation to European Union law is also an issue. For the judicial courts, four decisions of the Court of cassation have invoked the Charter of the Environment. Of these, three are classic judgments dealing with preliminary rulings on constitutionality, and the last is a decision on the merits rejecting, once again, the state of ecological necessity.Cette chronique couvre la période allant de juillet 2022 à juin 2024. Son passage à un rythme bisannuel nécessite, du côté de l’ordre administratif, une sélection drastique des jurisprudences et une approche plus quantitative de la matière. Deux décisions de principe sont à noter, en lien avec le référé-liberté et l’application du principe de précaution à la protection des espèces. Au-delà, des questions plus transversales reviennent de manière récurrente, comme sur le champ d’application de la Charte en lien avec les notions d’environnement et d’effets sur celui-ci. On y ajoutera, cette fois-ci, le positionnement de la Charte par rapport au droit de l’Union européenne. Du côté de l’ordre judiciaire, quatre décisions de la Cour de cassation relèvent l’invocation de la Charte de l’environnement. Parmi elles, trois sont classiquement des arrêts portant des questions prioritaires de constitutionnalité, et la dernière est une décision au fond rejetant, une fois encore, l’état de nécessité écologique.Cairn restricted access
