Summary:This column deals with the case-law relating to the French environmental Charter before the Council of State and the Court of cassation over the last two years (July 2022 – June 2024). For the administrative courts, two decisions of principle are worth noting, in connection with "référé-liberté" (a kind of summary proceeding) and the application of the precautionary principle to species protection. Beyond this, more cross-cutting questions recur, such as the scope of application of the Charter in relation to notions of the environment and effects on the latter. The Charter’s position in relation to European Union law is also an issue. For the judicial courts, four decisions of the Court of cassation have invoked the Charter of the Environment. Of these, three are classic judgments dealing with preliminary rulings on constitutionality, and the last is a decision on the merits rejecting, once again, the state of ecological necessity.
