On dit alors, précise le Professeur Hanotiau, que le litige n est pas arbitrable. Le Professeur Hanotiau consacre la première partie de son cours aux principes et au droit applicable qui décideront si un litige est un litige arbitrable ou non. M. Hanotiau distingue ici l arbitrabilité subjective de l arbitrabilité objective et évoque l attitude du tribunal étatique concurremment saisi nonobstant l existence d une clause d arbitrage. Dans la deuxième partie de son cours, le Professeur Hanotiau décrit la portée des prescriptions de non arbitrabilité et distingue trois catégories de législations en fonction de leur caractère libéral en ce qui concerne l arbitrabilité des litiges. La troisième partie du cours étudie la question à travers diverses applications, notamment en droit de la concurrence, en droit des sociétés, en droit fiscal, en matière de procédures collectives, de litiges de propriété intellectuelle ou de droit pénal. Dans la quatrième partie, le Professeur Hanotiau se penche sur l arbitrabilité lato sensu et sur le champ d application de la clause d arbitrage. Bernard Hanotiau recalls in the introduction to his course on arbitrability that, if parties can grant their arbitrators the jurisdiction to settle a dispute, the State preserves nevertheless the possibility to refuse the settlement out of state court of dispute categories. It is then said, states Professor Hanotiau, that the dispute is non-arbitrable. Professor Hanotiau devotes the first part of his course to the principles and applicable law that will decide if a dispute is suitable for arbitration or not. Mr. Hanotiau makes a distinction here between subjective arbitrability and objective arbitrability and examines the attitude of the state court when the dispute has been concurrently brought to court, notwithstanding the existence of an arbitration clause. In the second part of his course, Professor Hanotiau describes the range of provisions for non-arbitrability and distinguishes three categories of legislation, which he classifies according to how liberal they are with regard to the arbitrability of disputes. The third part of the course examines the question of arbitrability by looking at its various applications, in particular in competition law, in company law, in tax law, in collective proceedings, in intellectual property disputes or in criminal law. In the fourth part, Professor Hanotiau pays attention to the arbitrability lato sensu and to the application area of the arbitration clause. |
