Sumario:Organic Law 1/2023 of 28 February, amending Organic Law 2/2010 of 3 March on sexual and reproductive health and voluntary termination of pregnancy, amended the Spanish General Social Security Law in order to introduce three new situations of temporary incapacity arising from common contingencies linked to women’s sexual and reproductive health: incapacitating menstruation, voluntary or involuntary termination of pregnancy and the advanced stage of gestation. This is a pioneering regulation at European level in terms of social protection of women’s health, even if the measures introduced have raised certain questions which will be briefly addressed in a critical analysis.
