| Shrnutí: | The importance of soft law in international economic law has long been a subject of debate in academic literature. While it is now accepted that soft law contributes to the normative character of international economic law as a whole, some recent practices in the field of international trade are raising new questions. For example, the economic and trade agreement between China and the US of January 15, 2020, and the US-EU joint statement of October 31, 2021, call for a nuanced approach to the link between obligatoriness and justiciability. Another case is the Joint Initiatives launched within the WTO framework, which aim to create mandatory and justiciable norms, even though their lawfulness is questionable in light of the consensus principle applicable to the launch of multilateral trade negotiations. |
