Streszczenie:Le cours de Lawrence Collins, Lord Justice of Appeal, concerne les demandes politiques ou de droit public faites par des États devant les tribunaux d autres pays, et commence par l évocation de deux cas séparés l un de l autre d environ 150 ans, et mettant en scène deux personnages hauts en couleur, le Hongrois Louis Kossuth, et le Président Obiang de Guinée Équatoriale. Après un exposé historique des faits, à savoir d une part, les relations entre Louis Kossuth avec l Empereur d Autriche et, d autre part, du Président Obiang, de Guinée Équatoriale, qui aurait fait l objet d une tentative de coup d État, l auteur s intéresse dans un premier temps à l affaire Emperor of Austria v. Day and Kossuth et, pour ce qui concerne l affaire de la Guinée Équatoriale, à l affaire Equatorial Guinea v. Bank of Scotland International & Ors (Guernsey) et à Mbasogo v. Logo Ltd . L auteur s intéresse ensuite à d autres demandes intentées en justice sur le fondement du droit privé : les actions de l Iran contre le Shah, d Haïti contre Baby Doc Duvalier, des Philippines contre les Marcos, pour récupérer des actifs détournés, et du gouvernement britannique contre les éditeurs du Spycatcher. Enfin, l intéresse aborde la question des actions intentées sur un fondement de droit public, notamment en matière d application des règles concernant les titres financiers et les lois environnementales.
This course of Lawrence Collins, Lord Justice of Appeal, concerns the political or public law claims made by States in foreign courts and begins with mentioning two claims about 150 years apart, involving two colourful characters, Louis Kossuth of Hungary and President Obiang of Equatorial Guinea. After presenting an historic overview of the facts concerning on the one hand the relations between Louis Kossuth and the Emperor of Austria, and on the other hand, President Obiang of Equatorial Guinea, who allegedly was the object of an attempted coup d'état, in the next two chapters the author investigates in detail the claims concerning "The Emperor of Austria v. Day and Kossuth", and, concerning the case or Equatorial Guinea, "Equatorial Guinea v. Bank of Scotland International & Ors (Guernsey)" and "Mbasogo v. Logo Ltd". The author then discusses claims based on private law, such as those brought by Iran against the Shah, by Haiti against Baby Doc Duvalier, and by the Philippines against Mr. and Mrs. Marcos to recover misappropriated property, and the claim of the British Government against the publishers of Spycatcher, the book written by a former member of the British security services. Lastly the author tackles the question of claims based on types of public law, in particular concerning the enforcement of Securities Laws and Environmental Laws.
