Sažetak:The article addresses intellectual property and its interface with traditional knowledge and Indigenous Peoples. It begins by explaining why the World Intellectual Property Organisation (WIPO) began to address these issues in the late 1990s. The article identifies the gaps between IP systems and the aspirations of Indigenous Peoples, as well as ways in which Indigenous Peoples are making use of some IP tools such as collective trademarks. The scope of the new WIPO Treaty on Intellectual Property, Genetic Resources and Associated Traditional Knowledge is clarified. The use of terms such as ‘Indigenous Peoples’ and ‘local communities’ is discussed. The article distinguishes the purposes of UNESCO’s 2003 Convention from the WIPO’s work aimed at the legal protection of intangible cultural heritage. Finally, the article expresses caution concerning attempts to properties intangible cultural heritage and calls for a measured and balanced approach to this sensitive question.
