Descripció
Sumari:The principle of the division of powers doesn’t have effective application in the italian constitutional system. The reasons of this fact are the following ones: i) The influence of the principle of the “superiority of representative assembly”, that became the “centrality of assembly”; it means the centralization of competences in the legislators hands; 2) The weakness of the effective working of the principle of judicial indipendence; 3) The complete subordination of the cabinet on the assembly. This subordination hampered the development of a real parliamentary system of government. The dominance of a non-majoritarian political culture, that has been the main characteristic of italian political parties, exerted a great influence over this result. We can argue that a new costitutional system has to be built on an effective system of checks and balances.
