| Streszczenie: | The study deals with the question of transformation of public attitudes face to the crime of infanticide (murder of new-born baby by its mother) in the enlightened Habsbourg monarchy (with Tuscany) and France (comparison), and this mainly on the basis of legal norms, judicial court records and medical treatises as sources. It should be stressed that a most moderate repression adopted in Habsbourg monarchy (abolishing the capital punishemnt for such crime) promitted a most respect to the valid law. In France on the contrary, during the Revolution and Empire, the severe repression led the jurys to avoid the application of the penal norm and to « disculpabilize » the accusated young women. |
