| Sažetak: | This article analyses the secondary use of health data in the context of the European Health Data Space (EHDS), with a focus on scientific research purposes. Assuming that neither the EHDS nor the GDPR expressly address the public interest requirement relating to scientific research, the article aims to break down the term “health” into the related rights that can be exercised by individuals and groups involved in processing health data. It argues that the multifaceted nature of health data could lead to a more comprehensive level of protection by encompassing the participatory dimension of the right to health. To this end, the paper attempts to demonstrate its central argument that the right to science and the right to health should be considered complementary rights when assessing the reform of secondary use. |
