Résumé:The study aims at enlightening the crime of rape in the Maghreb from the Berber Revolution (122 h.) to the Arabs attacks (443 h.). The motives and causes of that crime varied according to the nature of the circumstances that pushed to commit it, and with the perpetrators’ and their victims’ personality; however, these motives show the context of security chaos, political turmoil and military conflicts that overcame Maghreb countries during that period. It was mostly related with the desire of taking vengeance from opponents and rebels, of humiliating them by violating their wives’ sanctity. The study found that rape did not become a ­criminal phenomenon, as the result of the spread of comfort women. It affected so negatively the victims’ psychology, that some of them dared to commit suicide in order to escape from a life of humiliation and scandal. The study establishes also that Maliki jurists were the most comprehensive in qualifying the crime of rape and scrutinizing its signs, the most insistent on the man’s behaviour, emphasising on his role in the event.
