Izvleček:Psychoanalytic legal theory usually only takes into consideration the quasi-exclusive role of the father in the Oedipus complex, thus systematically ignoring feminist psychoanalytic studies that expose the bias of this approach. In this essay, I present three psychoanalytic approaches that outline a “law of the mother.” Geneviève Morel bases her theory on the Lacanian concept of the “sinthome” and analyzes the legal consequences of ambiguous words spoken by the mother. For Juliet Mitchell, it is the mother who forbids murder and incest among her children, and the mother’s law paves the way for equality between the sexes. Amber Jacobs traces the law of the mother back to a matricide in the Orestes myth. I examine these theories and ask whether we can transpose them to a legal context. Finally, I outline a framework for a feminist legal theory, thus offering a new perspective for psychoanalytic legal theory.
