Özet:The notion of the extra-territoriality of law raises a number of questions regarding the principle of state sovereignty and the rules of public international law. Promulgated in 1977, the American anti-corruption regulation - otherwise known as the “FCPA” - is a topical example. The FCPA becomes a weapon of economic warfare which is used by the United States to undermine the national economies of both enemy and friendly countries, “for its own national ends”. If the extra-territoriality of the FCPA appears to be a formidable and paralyzing weapon, this power needs to be put into perspective. American domination in the fight against corruption is not inescapable: resistance is a matter for men, organizations and States, which for the moment are submitting to a legally unjustified political balance of power.
