| Summary: | How can the norm of “fair and equitable sharing of the benefits arising out of the utilization of Indigenous Peoples and Local Communities” Traditional Knowledge associated with genetic resources’ when it leads to biotechnological breakthroughs be effectively implemented? While the Nagoya Protocol establishes the contractual route for doing so, scientific literature and practice offer little guidance on how to achieve fair and equitable bioprospecting contracts. To fill this gap, this article proposes participatory action-research as a promising methodological approach. Using a real-life example, it shows that, by integrating its founding principles into bioprospecting operations, these become an exercise in building a “relationship” based on radical respect for the Other, beyond any transactional logic. |
