This proposal primarily aims to prevent the risks (highly emphasized) that TPLF could have on the integrity of judicial procedures. The desire to regulate deserves attention in terms of method and content. The regulation proposal does not aim to authorize or generalize funding contracts; this authorization falls under the choice of Member States. However, once they allow this mode of funding, States must comply with minimum standards for the protection of funded claimants, which extend to the three components of TPLF: the market, i.e., the approval and control of third-party funders, the contract, i.e., the content of funding agreements, and the procedure, i.e., the obligation to disclose funding agreements and the control of these agreements by the court.Le Parlement européen s’est saisi de la question de la régulation du financement de contentieux par les tiers (FCT) en adoptant, en septembre 2022, une résolution contenant des recommandations à la Commission et une proposition de texte de directive sur le financement privé responsable du règlement de contentieux. Cette proposition cherche avant tout à prévenir les risques (réels ou supposés, mais très accentués) que le FCT pourrait avoir sur l’intégrité des procédures judiciaires. Ce souhait de réguler mérite attention du point de vue de la méthode et du contenu. La proposition de régulation n’a pas pour objet d’autoriser ou de généraliser les contrats de financement ; cette autorisation relève du choix des États membres. Mais dès lors qu’ils admettent ce mode de financement, les États doivent se conformer à des normes minimales pour la protection des demandeurs financés qui s’étendent aux trois composantes du FCT à savoir le marché, i.e. l’agrément et le contrôle des tiers financeurs, le contrat, i.e. le contenu des accords de financement et la procédure, i.e. l’obligation de divulgation des accords de financement et le contrôle de ces accords par le tribunal.Cairn restricted access
