Περίληψη:The European Parliament has addressed the issue of third-party litigation funding (TPLF) regulation by adopting a resolution in September 2022 with recommendations to the Commission and a draft directive on Responsible private funding of litigation. This proposal primarily aims to prevent the risks (highly emphasized) that TPLF could have on the integrity of judicial procedures. The desire to regulate deserves attention in terms of method and content. The regulation proposal does not aim to authorize or generalize funding contracts; this authorization falls under the choice of Member States. However, once they allow this mode of funding, States must comply with minimum standards for the protection of funded claimants, which extend to the three components of TPLF: the market, i.e., the approval and control of third-party funders, the contract, i.e., the content of funding agreements, and the procedure, i.e., the obligation to disclose funding agreements and the control of these agreements by the court.
