الملخص:In a ruling handed down on January 18, 2024, the European Court of Human Rights found that France had violated Article 10 of the European Convention on Human Rights, which protects freedom of expression, in a case involving the conviction of an employee on charges of public defamation for denouncing, in an e-mail sent to a handful of recipients, the behavior of her superior as constituting, in her view, moral and sexual harassment and sexual assault against her. The violation was based on an application, deemed excessively rigid by the Court, of the rules of domestic law governing the publicity and legitimacy of the disputed expression.
