要約:Since its foundation in 1995, the South African Constitutional Court has played a crucial role in the political and social life of the country. It approaches the protection of human rights with a particular concern for vulnerable and marginalised groups, even when it must face the general disapproval of the population. As it is increasingly called upon to deal with the consequences of the persisting electoral dominance of a single party and the alleged impunity ofthe president and other members ofthe executive, it has seized the opportunity to try to correct abuses of power and to shield the functioning of the democratic institutions, at the risk of facing growing criticism for its “interference” in the political domain.
