Description
Résumé:Technological developments, and particularly the rise of electronic books, have led to clarification of the existence and, where appropriate, the scope of rental and lending rights in the digital environment. A crucial distinction between these rights allows for opposite regimes under Directive 2006/115/EC : while the digital rental right is prohibited, the public lending of a digital copy of a book has been enshrined, subject to certain conditions being met. Moreover, under European Union law, the exhaustion of rights does not apply to electronic books.
