| Özet: | This article aims to analyze some of the main legal and institutional elements that stand in the way of the success of public policies related to environmental protection and development in the Brazilian Amazon region. Specifically, problems related to implementing projects in the voluntary carbon market and implementing the rural environmental registry (CAR) were analyzed. These obstacles are presented under the concept of legal governance, which seeks to highlight the set of environmental rules and the interaction between their regulation and the actions of the bodies responsible for implementing them, as well as the effectiveness of these actions. As its starting point, the discussion discusses past development models for the region, whose mistakes are at the root of the identified legal governance problems, and the elements to be considered in development projects under construction. |
