It is used to justify restrictions on the circulation of goods, services and investments. In international trade law, despite attempts by WTO panels to ensure an objective assessment, the United States has systematically defended the self-judging nature of the national security exception. Moreover, reliance on national security is not limited either to the United States or to international trade law. The generalization of foreign direct investment screening mechanisms, and the gradual extension of their scope of application, is another good example. This new “security interventionism” is understandable in the current geopolitical context but makes it difficult to distinguish between legitimate security interests and protectionist economic policies.Notion aux contours mouvants, la sécurité nationale est invoquée de manière croissante dans le domaine des relations économiques internationales. Elle sert alors à justifier des restrictions à la circulation des biens, des services et des capitaux. En matière de commerce international, malgré les tentatives des groupes spéciaux de l’OMC d’assurer un contrôle objectif, les États-Unis ont systématiquement défendu la libre invocation de l’argument de sécurité nationale. Du reste, l’invocation de la sécurité nationale n’est limitée ni aux États-Unis, ni au droit du commerce international. La généralisation des mécanismes de filtrage des investissements directs étrangers, et l’extension progressive de leur champ d’application à des secteurs de plus en plus nombreux, en sont la preuve. Les raisons de ce nouvel « interventionnisme sécuritaire » sont à rechercher dans le contexte géopolitique actuel qui rend mal aisé la distinction entre intérêt sécuritaire légitime et politique économique protectionniste.Cairn restricted access |
