Résumé:National security is a shifting concept that is increasingly being invoked in international economic relations. It is used to justify restrictions on the circulation of goods, services and investments. In international trade law, despite attempts by WTO panels to ensure an objective assessment, the United States has systematically defended the self-judging nature of the national security exception. Moreover, reliance on national security is not limited either to the United States or to international trade law. The generalization of foreign direct investment screening mechanisms, and the gradual extension of their scope of application, is another good example. This new “security interventionism” is understandable in the current geopolitical context but makes it difficult to distinguish between legitimate security interests and protectionist economic policies.
