| সংক্ষিপ্ত: | With its very restrictive interpretation of the option of resorting to a shared initiative referendum to exit the 2023 pension crisis, the French Constitutional Council was actively involved in restricting the opposition’s ability to challenge decisions, weakening both parliamentary democracy and semi-direct democracy whilst allowing the executive free reign. Far from presenting a rigorous and strictly “legal” reasoning, these decisions taken by the Council illustrate the role that it plays in the (dys)functioning of the Fifth Republic’s democracy. They are the result of jurisprudential choices not without effect on the functioning of other political institutions, while rendering any recourse to this type of referendum illusory. |
