Resumo:Given the fragmented electoral results of 20 December 2015, choosing a new President of the Government was an extraordinarily difficult task; new general elections had to be organised on 26 July 2016, however the highly fragmented results of these elections in terms of the formation of the Congress of Deputies, did not allow for the constitution of a new Government until 31 October 2016. In the history of Spanish democracy, this is the longest period during which an outgoing government has remained in office to manage everyday affairs, i.e. a total of 315 days. This situation, resulting from the Government’s reticence to appear before the Congress, reopened the legal and political debate on caretaker governments, leading to a clash of powers between the Congress of Deputies and the Government, a conflict that was ultimately resolved by the decision of the Constitutional Court of 14 November 2018.
