| Sumario: | In this paper the author analyzes the main contemporary challenges of the “Rule of Law” in Spain, especially from the point of view of the possible existence of fissures in the recognition of a wide catalogue of fundamental rights, (sometimes “justified” from the perspective of public national security, or as it probably happened during the declaration of the state o alarm in December 2010 with occasion of the Spanish air traffic controllers´ strike), the separation of powers, (let´s see for example the abusive use of the exceptional legal figure of the Royal Decree-Law by the Government, and the political interferences in the election of the members of the General Advisory Council of the Judiciary Power), and the obedience to the Law by the power, (where we may remember the recent defiance from the pro-independence parties in Catalonia, with a very difficult solution). |
