How can the French State, since the 1905 Law of Separation [of the State and religious organisations], be held liable for acts committed within the religious sphere? Borderline cases do exist, in which this liability can be considered, albeit not without difficulty: these concern members of the clergy in Alsace-Moselle, where the “Concordat” regime [preceding the 1905 Law of Separation] still applies, and chaplains who officiate in public services. Far from a caricatured conception of the separation of Church and State, what is emerging is an intermingling of State and ecclesiastical responsibilities. |
