Izvleček:This article analyzes the complex relationship between morality, law and democracy in the political theory of Jürgen Habermas, especially in his recent work Faktizitaet und Geltung and in the essays of the last years. In his book, Habermas rejects the idea of a moral foundation or justification of law, which he has accepted in his writings before Facts and Norms. In Habermas' view, between morality and law there is a relationship of coordination, and not of subordination. This point is criticized in the paper, because, according to Petrucciani, a kind of primacy of morality vis-a-vis law is recognized also by Habermas' theory, although implicitly.
