| Gaia: | Habermas' conception of the democratic State of law are normatively stimulating, though they are more questionable in their historical and sociological perspectives. This paper presents briefly the way Habermas conceives institutionalization of communicative reason in representative democracies, and his justification of civil disobedience as a litmus test for the democratic constitutional State. A third part criticizes his sharp distinction between civil disobedience and resistance and his rejection of the later in contemporary societies. Concluding comments emphasize the paradigm that civil disobedience nevertheless represents for any contemporary form of resistance to oppression. |
