Zusammenfassung:Social relations today generally take on the form of contracts and covenants. In continental law, this form partly replaces the legal configuration of the State. For Marxism, the mechanism of social regulation by contract is traditionally explained in terms of the generalisation of the capitalist market. We argue that, on the contrary, the generalisation of contractual relations is to be explained in terms of new forms of capitalist production, and new uses of social technology. Such an approach leads to a consideration of law as the mode enabling the construction of social relations through interindividual one.
