Article 131-21 of the Penal code indeed allows the confiscation of assets over which the convicted person only has « free disposal » (« libre disposition »), suggesting that a third parties, who own the confiscated property, could be directly affected by this penalty without having been found guilty of the offense it sanctions. However, the notion of « free disposal » is surrounded by uncertainties. While Article 544 of the Civil code defines disposal as an attribute of the right of property, does it, in the sense of the Penal code, refer to a simple de facto control over another's property or a curious method of property acquisition with a repressive purposes ? In either case, it appears that the constitutionality and the compliance of the article 131-21 with the European convention may be called into question.La confiscation est une privatisation de propriété prononcée à titre de peine. Son domaine ne paraît cependant pas limité aux biens dont la personne condamnée est propriétaire. L'article 131-21 du code pénal permet en effet de confisquer les biens dont celle-ci n'a que « la libre disposition », ce qui suggère que des tiers, propriétaires des biens confisqués, pourraient être affectés par la peine de confiscation sans pour autant avoir été reconnus coupables de l'infraction qu'elle sanctionne. La notion de « libre disposition » est toutefois bordée d'incertitudes. Tandis que l'article 544 du code civil fait de la disposition un attribut du droit de propriété, désigne-t-elle, au sens du code pénal, une simple emprise de fait sur les biens d'autrui ou un curieux mode d'acquisition de la propriété à finalité répressive ?
