En particulier, dans sa décision n° 2011-625 DC, le Conseil constitutionnel apporte d'importantes précisions relatives à l'interdiction de privatiser la police ainsi qu'à l'exigence de direction et de contrôle de la police judiciaire par l'autorité judiciaire. Contributing elements drawn from the commentary on the Constitutional Council's « LOPPSI » decision In its « LOPPSI » decision, delivered on 10 March 2011, the Constitutional Council reinforced the essential distinction to be made between the two types of police (administrative and criminal investigation) in constitutional jurisprudence in order to resolve the conflict between rights and freedoms guaranteed by the Constitution and policing arrangements. At the level of these rights and freedoms, this distinction between the two types of police effectively means that, by focussing solely on the objective pursued (safeguard of public order or search for individuals who have committed crimes), a certain number of constitutional limits can be defined. In particular, in its decision no. 2011-625 DC, the Constitutional Council has clarified a number of important issues in relation to the prohibition on privatising the police as well as on the requirement that the criminal investigation police be supervised and controlled by the judicial authority.
