De fait, l’argument de la necessitas comme justification de l’exception est ancré dans une doctrine canonique qu’illustrent le principe necessitas non habet legem, la théorie canonique de la dispense, ou encore diverses occurrences antérieures dans les discours pontificaux. Aussi la taxation de 1225 fait-elle apparaître un véritable mécanisme d’appropriation d’une doctrine canonique par la pratique temporelle, sous l’influence directe de la papauté.The use of necessity in discourses aimed at justifying exception is well known among decisions made by secular powers from the thirteenth century onward. Such a practice existed in England and France, and specifically emerged under Henry III of England. However, his decision to levy taxes in 1225, justified by necessity, was inseparable from a papal intervention by Honorius III, who used this argument in a letter and appears to have been a decisive inspiration for Henry. Indeed, the use of necessitas to justify exception is rooted in canonical doctrine, as illustrated by the well-known principle necessitas non habet legem, the theory of dispensation, and previous occurrences in papal sources. The royal taxation of 1225 therefore reveals a mechanism of appropriation of a canonical doctrine by secular power, under the direct influence of the Pope.Cairn free access
