All the sectors involved in this operation have been mobilised and adapted to meet the challenge posed by the text: to enable the development of industries supporting the ecological transition on French territory in order to face up to international competition in this area. To this end, the law transforms planning law, industrial law, mitigation banks law and elements of financial law. While the Industrie verte Act does have a green dimension, it however pales in comparison with the real objectives of the text, which are essentially economic, social and sovereignty-related.La loi Industrie verte modifie le contexte juridique de déploiement d’installations industrielles. Tous les secteurs concernés par cette opération se trouvent mobilisés et adaptés à l’enjeu porté par le texte : permettre l’essor d’industries soutenant la transition écologique sur le territoire français pour faire face à la concurrence internationale en la matière. À cette fin, se trouvent notamment transformés par la loi le droit de l’urbanisme, plus généralement celui de l’aménagement du territoire, le régime des ICPE, celui de la compensation écologique, du droit de la commande publique ou des éléments de droit financier. Si la loi Industrie verte possède bien une dimension verte, celle-ci est cependant bien pâle au regard des objectifs réels du texte, essentiellement économiques, sociaux et de souveraineté.Cairn restricted access |
