Scientific studies have demonstrated its harmful effects on a wide range of marine species: masking of communications, behavioral response, hearing loss, and even lethal injury. This intersectoral and transboundary environmental issue has only recently been addressed by law. Yet the benefits of regulating underwater noise-generating activities are obvious: if adopted, they can immediately reduce the noise emitted by the regulated activity. French law deals with underwater noise only in an incidental way, which remains limited. This article therefore explores how the issue is addressed by international environmental law, including by soft law instruments. This study received financial support from the Port-Cros National Park, the Regional Council of Provence-Alpes-Côte d’Azur and the Prince Albert II of Monaco Foundation.Le bruit sous-marin d’origine anthropique n’a cessé d’augmenter depuis le XXe siècle avec le développement des activités humaines en mer, or les études scientifiques ont révélé l’existence d’effets néfastes de celui-ci sur un large éventail d’espèces marines : modifications comportementales, masquage des communications, perte d’audition, et même, lésions létales. Cette problématique environnementale, aux caractères intersectoriel et transfrontière, n’est prise en compte par le droit que depuis peu. Pourtant, l’intérêt d’une réglementation des activités génératrices de bruit sous-marin est évident : son adoption peut permettre l’atténuation immédiate du bruit émis par l’activité réglementée. La réglementation applicable demeure limitée en droit interne, le bruit sous-marin n’étant pris en compte que de façon incidente. Il convient alors d’étudier comment cette nuisance est appréhendée par le droit international de l’environnement, y compris par les instruments de soft law.
