Promulgated in 1977, the American anti-corruption regulation - otherwise known as the “FCPA” - is a topical example. The FCPA becomes a weapon of economic warfare which is used by the United States to undermine the national economies of both enemy and friendly countries, “for its own national ends”. If the extra-territoriality of the FCPA appears to be a formidable and paralyzing weapon, this power needs to be put into perspective. American domination in the fight against corruption is not inescapable: resistance is a matter for men, organizations and States, which for the moment are submitting to a legally unjustified political balance of power.La notion d’extra-territorialité du droit soulève de nombreux questionnements au regard du principe de souveraineté des Etats et des règles du droit international public. Promulguée en 1977, la règlementation américaine sur la lutte contre la corruption – autrement appelée « FCPA » – est un exemple topique. Le FCPA devient une arme de guerre économique que les Etats-Unis utilisent pleinement pour fragiliser les économies nationales des pays ennemis mais également des pays amis et ce, “à des fins nationales personnelles”. Si l’extra-territorialité du FCPA semble constituer une arme redoutable et paralysante, cette puissance doit être relativisée. Neutraliser, voire paralyser l’extra-territorialité du FCPA est possible. La domination américaine en matière de lutte contre la corruption n’est donc pas inéluctable : la résistance est une affaire d’hommes, d’organisations et d’Etats, lesquels, pour l’heure, se soumettent à un rapport de force politique juridiquement injustifié.Cairn restricted access
