Concrètement, il explique la responsabilité des auteurs de tels comportements, comme l’internaute ou le fournisseur d’accès, ainsi que la possible existence de motifs qui justifient le téléchargement, comme l'exception de copie privée.The volume of illicit downloads on the Internet poses a threat for the cultural industry because of the reduction of the authors’ rights it represents. The present contribution analyzes the legal treatment in French law of the illicit downloads from the Internet of works protected by intellectual property rights. Concretely, it explains the responsibility of the persons who take part in the conduct, such as the internet user or the access provider, as well as the possible existence of reasons that justify the download, such as the private copy exception.El volumen de descargas ilícitas en la red supone una amenaza para la industria cultural, por el menoscabo de los derechos de autor que representa. El presente trabajo analiza el tratamiento jurídico que se da en Derecho francés a las descargas ilícitas a través de Internet de obras sometidas a derechos de propiedad intelectual. Concretamente, explica la responsabilidad en que pueden incurrir desde el internauta hasta el proveedor de acceso, así como la posible existencia de motivos que justifiquen la descarga, como la excepción de copia privada.Cairn free access
