The practice of standard contracts for the sale of cocoa and coffee, which require producers to make an upfront payment, rightly constitutes an excepted case, without any legal basis, and confirms the abuse of economic and the imbalance between the parties in these contracts Le thème de « l’exigence d’un paiement préalable d’entrée dans les contrats-types de vente internationale de cacao et de café » met en relief des situations de déséquilibre et d’abus de puissance économique dans les pratiques contractuelles. De façon générale, l’accès au contrat est dénué de toute exigence financière préalable, l’engagement contractuel étant fondé sur le seul principe de l’autonomie de la volonté.
