This is why it is important to check whether the promised rights are as effective as the developments in the procedures. Various concrete illustrations allow us to doubt this and are presented, before studying a paradigm brought up to date with the “politique de l’amiable” (amicable settlement policy), which can certainly lead to a positive assessment of principle when the judge has not a power of proposal, but which is a little more doubious when the amicable settlement is intended to be binding. From this rather bitter observation comes a wish to rethink justice. The first step requires to awaken the conscience of politicians, intellectuals and judges themselves. The second is to curb excessive formalism, which is an obstacle to the right of access to the judge. The AI legal tools and their look of modernity are then analyzed which, echoing the beginning of the 16th century and the figure of Judge Bridoye, should lead us to avoid the outcome of a trial being decided by dice!Le progrès d’une science ne peut être dissocié de son impact sur l’humain, sauf à basculer dans l’inhumanité. C’est pourquoi il est important de vérifier si l’effectivité du droit promis est au rendez-vous des évolutions de la procédure. Diverses illustrations concrètes permettent d’en douter et sont présentées, avant que ne soit étudié un paradigme mis au goût du jour avec la « politique de l’amiable », qui peut certes aboutir à une appréciation positive de principe quand le juge n’a qu’un pouvoir de proposition, mais qui est un peu plus douteuse quand l’amiable se veut contraint. De ce constat assez amer s’extrait un vœu visant à repenser la justice. Une première étape impose un réveil des consciences, tant des politiques et des intellectuels que des juges eux-mêmes. La seconde vise à canaliser tout formalisme excessif, qui est une entrave au droit d’accès au juge. Sont alors analysés les systèmes de décisions facilités par l’IA et l’apparence de modernité qui, en écho avec le début du XVIe siècle et la figure du juge Bridoye, doit nous conduire à éviter que le résultat du procès ne se joue aux dés !Cairn restricted access
