While the financing of legal actions of these vulnerable people, who are the subject of both particular exposure and specific legal treatment, constitutes a constant concern of public policies, the question of the privatization of mechanisms of financing of legal costs for these categories of people deserves at least to be asked. In theory, third-party financing of litigation could be an attractive solution for the most vulnerable people. The reality, however, seems more complex and already requires distinguishing the vulnerable person taken individually from vulnerable people taken collectively. While the third party financier is clearly disinterested in the first category, the second could arouse its interest in the short or medium term. In the meantime, access to justice for the vulnerable public remains ensured by traditional financing mechanisms, which also have their limits.Le financement du coût de la justice soulève des questions spécifiques lorsqu’il concerne des personnes touchées par des vulnérabilités. Alors que le financement des actions en justice de ces personnes vulnérables, qui font à la fois l’objet d’une exposition particulière et d’un traitement juridique spécifique, constitue une préoccupation constante des politiques publiques, la question de la privatisation des mécanismes de financement des frais de justice pour ces catégories de personnes méritait au moins d’être posée. En théorie, le financement du contentieux par des tiers pourrait constituer une solution intéressante pour les personnes les plus vulnérables. La réalité semble cependant plus complexe et suppose déjà de distinguer la personne vulnérable prise isolément des personnes vulnérables prises collectivement. Alors que le tiers financeur se désintéresse clairement de la première catégorie, la seconde pourrait susciter son intérêt à court ou moyen terme.
