Litigation funding is primarily governed by the parties’ agreements, so much so that these agreements arguably play a normative role, contributing to the privatization of justice that the litigation funding market tends to promote. The contents of the funding agreement can thus be, at its level, a reference of this phenomenon. This article assesses the role that litigation funding agreements take in the privatization of justice, through an analysis of current practices and the limits to party autonomy. : Le financement de procès par des tiers relève d’une pratique ancienne et hétéroclite. L’émergence de financeurs professionnels interroge toutefois quant à l’influence d’un marché financier de l’action en justice en pleine expansion sur le fonctionnement de la justice. Le contrat de financement de procès devient l’instrument premier d’organisation de ce marché, au point de jouer un rôle normatif à son échelle. À ce titre, il a vocation à participer à la privatisation de la justice que le marché qu’il régule tend à promouvoir. Le contenu du contrat de financement peut alors en être, à son niveau, un marqueur. Dès lors, pour appréhender la façon dont le contrat participerait du processus de privatisation de la justice, il est opportun de mesurer l’espace de liberté contractuelle sillonnée par la pratique et d’en examiner les limites.Cairn restricted access
