On top of the damage suffered the claimant must dedicate time and energy with legal merits, claim value and substantiation, recovery outlook, lawyers to appoint, etc. A third party specialized in funding without recourse the related costs (here for international arbitration procedures), can provide the claimant with a useful added value as well as with a de-risking financial support alongside the full process. At the delicate crossroad between the deed of justice and the financial world this industry is unique: most people at work there are former lawyers or legals, law being the rationale, but this must combine with an internal expertise in the valuation of damages, as well as in recovery strategies, which are key in the risk-mapping of any entity looking at endorsing litigation funding. The article presents these multi-sided mechanisms enabling the provision of financial means backing a party to a dispute and how alignment of interests with the funded party optimizes the efficiency of the whole dispute resolution gearing.Un litige commercial monopolise du temps et l’énergie des parties au détriment de leur activité commerciale. En plus du préjudice subi, il faut travailler sur les mérites juridiques, valoriser et étayer la réclamation, envisager un plan de recouvrement, engager des avocats, etc. Une partie tierce spécialisée dans le financement sans recours de la résolution des litiges (en l’occurrence en arbitrage international) peut apporter une réelle valeur ajoutée, au-delà du transfert de risque représenté par l’apport du financement durant toute la procédure. À la délicate croisée des chemins entre la justice et la finance, il s’agit d’une activité très atypique : les personnes qui y travaillent sont essentiellement d’anciens avocats et juristes car le droit sous-tend l’équation à résoudre, mais il doit s’associer avec une expertise interne en valorisation des pertes subies, de même qu’en stratégie de recouvrement, qui sont cruciales dans la cartographie des risques de tout acteur du financement de litige. L’article présente les multiples facettes des mécanismes permettant la mise en place de financements au bénéfice d’une partie au litige, et la façon dont la convergence d’intérêts ainsi construite peut contribuer à améliorer l’efficacité de sa résolution.Cairn restricted access
