Tunisia adopted a new constitution on the January 27th, 2014. The “traditional” grasp of the religious feeling and the “modern” ascendancy of the democratic and liberal belief cross paths in it. The analysis of the new constitutional provisions make it possible to appreciate a priori what are and what will be the relations maintained between political power and Islam in Tunisia, or in other words, to define what are the legal data for the national balance in this matter. The Islam is consecrated as the religion of the Tunisian state; however, religious principles are not directly a law provisions origin. Therefore this compromising text can lead the legislator to adopt laws being at variance with either a religious provision or an international human rights provision. It will be up to an entitled judge, especially a constitutional judge, in light of prevalence rules and his text’s interpretation, to determine the constitutional and political balance in Tunisia regarding religious matters.Cairn free access
