Pénétré de l importance que revêtent les faits en matière de résolution des différends, le juge Mosk propose dans les premiers développements de son cours une approche générale de ce que sont les faits et du rôle de leur détermination dans la résolution des différends internationaux. Le juge Mosk illustre cette question d exemples récents tirés de la pratique de l Iran-United States Claims Tribunal. Le juge Mosk aborde ensuite de manière très détaillée la question de la collecte et de la présentation des faits et de leur rôle à tous les stades de la procédure, de la plaidoirie à l enquête pour enfin parvenir au dernier stade du processus, qui est la prise de décision par les arbitres, décision qui s appuie sur une délibération nourrie par les faits. Pendant ce cours, le juge Mosk s attache à démontrer l importance que revêtent les faits et l importance pour les instances judiciaires et les arbitres de leur capacité à les réunir.

Convinced of the important role that facts play in the resolution of disputes, the author starts by a general explanation of what facts are and the role they play in the resolution of international disputes. Richard Mosk illustrates this topic with recent examples taken from the Iran-United States Claims Tribunal. He then proceeds with a detailed examination of the methodology of gathering and presenting facts and of their role at every procedural stage, from the first hearing to the investigation, to finally arrive at the last stage of the process, which is that of decision-making by the arbitrators, a decision that is based on a deliberation nourished by facts. Throughout this course, the author endeavours to show both the importance of facts and the importance of the ability of the judicial authorities and arbitrators to draw conclusions based on these facts.
