Dans ce cours, le Professeur Lowenfeld s appuie sur un grand nombre de cas de jurisprudence. Après avoir redéfini la notion de droit international privé, le Professeur Lowenfeld s intéresse aux limites de la compétence des États, à la compétence des tribunaux, à la compétence nationale relativement aux entreprises multinationales, à la reconnaissance et à l exécution des jugements étrangers, au conflit apparu entre les Etats-Unis et l Europe à propos de la notion de discovery ,à la Convention de la Haye sur les preuves, à l autonomie des parties, et à la recherche d un principe unificateur du droit international privé. | ||

He intends rather to concentrate on topics that are of particularly importance for lawyers advising actors on the international transaction stage or governments, topics that are generally not touched upon in courses on public international law or private international law. In this course, Professor Lowenfeld draws heavily on jurisprudence. After redefining the concept of private international law, Professor Lowenfeld focuses on the limits of the jurisdictions of the States, the jurisdiction of courts, national jurisdiction and the multinational enterprise, the recognition and the enforcement of foreign judgements, the conflict between the United States and Europe with regard to the concept of discovery , the Hague Evidence Convention, party autonomy, and the search for a unifying principle of private international law. | ||
